AJ. This is Doctor Lewis, The mother of Brad Schwartz called asking for assistance. Do we have absolute proof that both Schwartz and Biggers are innocent in the death of Brian Stidham.

As with all court cases, the standard is “proof beyond a reasonable doubt,” not “absolute proof.” I would think if there were “absolute proof,” the defense would have presented it. Nobody confessed, nobody has come forward to say they saw the murder occur and there are no cameras that captured the murder as far as we know. And two juries found them guilty beyond a reasonable doubt.
She probably won’t like that answer, but that’s how it stands.
And even though it sounds messed up, appeals are more about whether court procedure was followed and the trial was considered fair (by court standards) than actual guilt or innocence. Certainly, though, convictions have been overturned when exculpatory evidence was either suppressed or unknown at the time of trial.
