Here is a copy of the haunting document Mr. Sommer discovered at the age of seventy-nine in the Suffolk County Police Archives, forty-four years after going to prison. The covered-up Supplementary Report completed by a detective who kidnapped him shows that Mr. Sommer should have never stood trial due to the dismissal of grand jury indictments for his arrest. It was conveniently submitted to a carton headed for basement darkness a month after Mr. Sommer went to prison.

This Police Department, County of Suffolk Court Disposition Report (not deposition) completed on the day Mr. Sommer was kidnapped in 1968 shows a crossed off letter “a” after the word Dismissed. This negates and contradicts a 2017 argument by the Suffolk County DA about a typo (referring to the Supplementary Report that did not contain the crossed off letter).
This Police Department, County of Suffolk Court Disposition Report (not deposition) completed on the day Mr. Sommer was kidnapped in 1968 shows a crossed off letter “a” after the word Dismissed. This negates and contradicts a 2017 argument by the Suffolk County DA about a typo (referring to the Supplementary Report that did not contain the crossed off letter).
A copy of a check from Suffolk County in 1979 sent to Mr. Sommer in prison further proves his innocence. His arrest was both unlawful and criminal in nature. Seeking another appeal with the check as leverage, an appellate court claimed the money was for damages, not a settlement. Ironically, Mr. Sommer’s 1969 victorious Huntley Hearing was based on the same admission, meaning his unlawful arrest superseded any recognition of damages. Further appeals were repeatedly delayed or ignored before his release in 1991.

This undated document allegedly submitted at some point during or after Mr. Sommer’s 1969 Huntley Hearing (although it was not found in the trial transcripts) was prepared by then Suffolk County DA George Aspland. It clearly raises more than enough reasonable doubt that Mr. Sommer did not murder Irving Silver.
